Terms & Conditions

These terms apply to every order placed on vivapack.co.uk with Vivapack Ltd (company number 08647535). By placing an order you accept them.

1. Products and prices

  • Our products are plastic pots and lids sold by the box. Each box contains the number of pots and matching lids stated on the product page. Boxes are not split.
  • Prices are shown excluding VAT by default, with an inc-VAT option. VAT at the current rate is added at checkout. Plastic Packaging Tax is included in the price shown and is not charged separately.
  • Quantity discounts apply automatically at checkout as shown on each product page.
  • We may change prices at any time, but a change won't affect an order you've already placed.

2. Orders

  • Your order is an offer to buy. We accept it when we send the dispatch email; until then we may decline it, for example if stock has run out or there's a pricing error, in which case we'll refund anything you've paid.
  • Images are for guidance. Nominal capacities (for example "365ml") are the usual working volume; brim-full capacity is larger and is given in the specifications where available.
  • Pot and lid dimensions may vary by up to 3% from the stated figures.

3. Delivery

Delivery charges, timings and areas are set out on our Delivery & Returns page, which forms part of these terms. Risk in the goods passes to you on delivery. Ownership passes when we've received payment in full.

4. Returns and faulty goods

Our returns process is on the Delivery & Returns page. Nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 if you're buying as a consumer.

5. Use of the products

Our pots are made from mono-material polypropylene in a BRCGS-certified plant and are supplied with a Declaration of Compliance covering food contact. If you use them for anything other than food, you're responsible for checking they're suitable for your product and for any rules that apply to it. Temperature limits are given on each product page.

6. Made-to-order products

Coloured pots, printed pots and pallet quantities are quoted separately and are subject to the terms set out in the quote, including minimum quantities, lead times and payment terms. They can't be returned unless faulty.

7. Liability

We're responsible for losses you suffer that are a foreseeable result of our breaking these terms or failing to use reasonable care, but not for business losses such as lost profit or lost business, and our total liability for any order is limited to the price you paid for it. Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or anything else that can't be limited by law.

8. General

  • These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction.
  • If any part of these terms is found invalid, the rest still applies.
  • We may update these terms; the version on the site when you order is the one that applies.
